1. Scope
This Policy and these Terms of Use apply to all websites offered by tedrive. They refer solely to the actions of tedrive regarding the website users’ data.
2. Definitions
“Personal Data“ is data which relates to a living individual and makes them personally identifiable by direct (e.g. birth date) or indirect (e.g. address or telephone number) means. This term does not include information that has been made anonymous and cannot provide direct reference to a specific person, e.g. the number of visitors to a website within a certain period of time.
All websites that tedrive offers information on are called collectively „tedrive’s website“. tedrive Holding B.V. or its subsidiaries or affiliated companies are named „tedrive“ in the following. Registered tedrive-website visitors will be referred to as „User“. Personal data provided by individuals, during registration as user for tedrive’s website, will be referred to as „registration information“.
3. Principles for the processing of Personal Data
3.1 tedrive’s website is operated in Germany. The German Federal Data Protection Act (Bundesdatenschutzgesetz) is applicable to the collection, processing and use of personal data by tedrive.
- 3.2 tedrive uses the users personal data for the limited purpose to provide our websites services. We will not disclose your personal data to third parties for advertisement or marketing purposes, or transfer your personal data to third parties except it is mandatory for tedrive in order to fulfil its services
- 3.3 Exceptions to number 3.2 can evolve under legal provisions fulfilling the instructions of criminal prosecution authorities and other state authorities or in the case of a strong suspicion of unlawful misuse of tedrive’s website.

4. Server Logs
The so called server log automatically records every page requested. These "server logs" include:
- The users’ internet protocol address (that may uniquely identify the computer)
- The remote host (name and IP address of the requesting computer)
- Time, status, transferred data, as well as the internet page which linked the user to the requested page (so called “Referrer”), plus the product and version information of the browser used (so called “User-Agent”).
tedrive analyses the server’s log file if at all for statistic purposes only. This serves for optimizing tedrive’s website by analyzing the site usage related to days and times as well as the requested data volume from tedrive’s website. Furthermore tedrive is able to detect possible errors e.g. corrupted links or bugs, based on the server’s log file, and thus to improve and develop the tedrive-website. tedrive will principally not refer the information stored in the server log like page requests and site usage to personally identifiable persons. However, tedrive reserves the right to screen server log files of users afterwards, when there is a suspicion of illegal and/or contract contrary usage of tedrive’s website. 5. Usage by Minors
Registration is reserved to adults and representatives authorized by companies subject to registration.
6. Changes to this policy
tedrive may update this policy at any time if changes are necessary due to an afterwards identified regulatory gap, in respect of new by tedrive provided functions or do to new legal requirements. tedrive will inform all registered users about all changes of this policy by e-mail to the addresses provided during registration.

8. Intellectual Property Rights
All on tedrive’s website contained intellectual property are protected by copyright, patent law and trademark rights as well as related rights. tedrive's websites grant no licenses in the sense of these laws. Without written permission by tedrive, it is prohibited to modify, distribute, reproduce, copy and mirror or any other use of the content which goes beyond the acquisition of information, of tedrive’s website.
9. Liability
- 9.1 tedrive’s website is published with extraordinary diligence. As far as possible the website is constantly updated. Despite of all care taken, tedrive cannot guarantee correctness and actuality. Therefore tedrive shall not be held liable except in case of intent or gross negligence by tedrive. The above mentioned liability limitation shall not apply with culpable injury to life, limb or health and guaranteed features as well as in the case of infringement of primary obligations.
- 9.2 The same applies to external content, reached via internal links or comparable in tedrive’s website. The user acknowledges that any liability for the content of the linked sites is excluded. In particular tedrive has no influence of the adherence of data protection requirements by third parties.
10. Severability Clause
If, at any time, any provision of these data protection terms, or parts thereof, should be considered void, the remainder of these terms shall continue in full force. The void provision will be replaced by a valid provision that best fulfils the intended economic purpose. This shall also apply in the case of a contractual gap.
